These Terms and Conditions apply to all orders placed via our website and call centre. Please take time to read these Conditions. These terms govern the contract between you and us in relation to the purchase of tickets from this website.
1. Our relationship to you
We own certain tickets which we have purchased from certain theme park operators. We are reselling these tickets to you.
1.1 The contents of this website constitute an offer to sell you a ticket and invite you to make an offer to purchase the tickets displayed on the web site. When you click complete order, you are making an offer to the Travel Company (subject to availability) to purchase the tickets from us.
1.2 When we receive your order, we check to see if the tickets are available and we then check your details and payment details. If that is in order we then accept your offer and charge your credit card or debit card for the indicated amount.
1.3 Your contract with us is formed when this happens and we then send you an e-mail confirming that we have accepted your order. We will endeavour to send you this e-mail as soon as possible. The e-mail will confirm your order details and the total payment charges. It will also confirm when your ticket will be dispatched to you.
1.4 If the tickets you have requested are no longer available, we will contact you by e-mail as soon as possible to let you know. We will not charge your card in these circumstances.
1.5 These tickets give you the right to visit and use the facilities of the theme park operator in question. These tickets are explicitly subject to the terms and conditions of these theme park operators and are set out on the theme park operators website provided below. The facilities and services provided by the theme park operators to you and your family/friends is a matter between you and the theme park operators themselves. We are solely selling you tickets which enable you to enter and use the theme parks.

2. Privacy Policy
Security of personal data is one of our primary concerns.
2.1 All personal data entered by you is used for the following purposes:
- To fulfil your order requirements and deliver what you have asked for; and
- To communicate with you.
2.2 Every purchase made through our website is done through our Secure Server Technology using a secure protocol called SSL which means that you can make payment with confidence knowing that your details are safe.
2.3 We also use session cookies to capture data on our website, which we use to provide you with tailored information from our website. 2.4 If you have ticked the relevant box (giving your consent) we may communicate to you by email for the purpose of informing you about our products and special offers. However, we will not do this if you do not tick the box.
2.5 You hereby confirm that you have provided us with accurate and current information about yourself and that the credit or debit card you are using is your own.
2.6 You have the right to ask for a copy of the information held by us in our records (which are subject to The Data Protection Act 1998) in return for payment of a fee. You also have the right to require us to correct any inaccuracies in your information by contacting us at leisureservices@bcdtravel.co.uk.
2.7 We will not transfer your details to any third parties save for the purposes of fulfilling your order unless you have requested us not to do so. You do however consent to us transferring your details in the event that we sell the business to a third party.

3. Prices and Description
Our prices are set out on our website in Pounds Sterling and are inclusive of United Kingdom-rated VAT. All orders are subject to availability of tickets.
3.1 Whilst we try to ensure that all prices and descriptions on our website are accurate, mistakes can sometimes occur or circumstances can change which mean that the products which are available are different from those advertised. If we discover an error in the price or in the available tickets then we will use our best endeavour to contact you as soon as possible and give you the option of either reconfirming your order at the correct price and with the correct description or cancelling it. If you elect to cancel your order or we cannot contact you then we will cancel your order and you will receive a full refund.
3.2 Every reasonable effort will be made to ensure that the theme parks descriptions that we feature on the website are accurate at the time. We strongly advise you to check all the details of your chosen theme park or attraction at the time of booking since we provide such descriptions for guidance only .Please refer to clause 1.5 where you will find the theme park operators website addresses.
3.3 Please note that there may be additional charges to those referred to in clause 3 which, if applicable to your order you will be liable to pay in accordance with these conditions. The additional charge is as follows:
3.4 Upon request your tickets may be delivered to you by special delivery post within 10 days of travel, in this instance there will be a postal charge made in accordance with these terms and conditions.
3.5 In order to purchase tickets on this website you must be over 18 years old and you must be able to lawfully enter into and form contracts under UK law.
3.6 Tickets are not transferable and must be used on any and all days as specified.
3.7 We accept payment by Visa, Master card, Solo, Maestro, JCB, Delta.
4. Delivery
4.1 Our aim is to ensure the delivery of your tickets by using Royal Mail. We will deliver tickets ordered by you to the address stated on your order form which must correspond to the billing address of the credit or debit card you have used to purchase the tickets.
4.2 We make a charge of £4.95 for special delivery to addresses within the U.K, if you request your tickets to be delivered within 14 days of travel. This charge will be automatically added to the total amount charged to your credit or debit Card.
5. Cancellation
5.1 Please note that, once we have processed your order you can only cancel it or receive a refund in accordance with the relevant third party supplier's terms and conditions which may impose cancellation charges. In addition you may also be subject to The Travel Company's administration charges which will be advised at time of cancellation.
5.2 If you send the tickets to us please ensure that you can provide proof of delivery. The Travel Company will enquire on your behalf whether a refund is available. The tickets must not have been, utilised, defaced or damaged in any way. All correspondence shall be addressed to BCD Travel, Suite H, Anchor house, The Maltings, Silvester Street, Hull, HU1 3HA.
6. Circumstances outside of our control
We can not be held liable for any loss, damage or expense whatsoever, where the performance of this contractual agreement is affected by any form of Government intervention, strikes, war and threat of war, terrorist activity, national nuclear disaster, late delivery, adverse weather conditions, and cancellations of performance (such circumstances being herein referred to as Force Majeure).
7. Complaints

8. Limitation of Liability
8.1 We are responsible for selling tickets which permit you entry and usage of the facilities described on this website. If we sell you tickets which are invalid or unusable then we will offer you a full refund of the amount paid.
8.2 Save as aforesaid and except in relation to liability for death or personal injury arising out of negligence, fraudulent misrepresentation or any other liability which cannot be excluded or limited by law, we will not be liable to you under any circumstances for any costs or damages whatsoever arising out of, in connection with or in any way related to your use of the website, the content of the website and/or any order made by you.
8.3 Nothing in these terms and conditions shall be construed to exclude or limit any rights you may have as a consumer to the extent that such liability and rights may not be excluded or limited under applicable statute or law.
8.4 Please note that you may not re-sell or transfer your tickets for profit or commercial gain. Should you do this then these tickets will be automatically voided.
9. Passports
Everyone normally requires a valid passport and sometimes a visa to travel abroad. Please ensure that you and any members of your party have valid passports and visas.
10. LINKS TO THIRD PARTY WEBSITES
This website contains hyperlinks to websites operated by parties other than The Travel Company. Such hyperlinks are provided for your reference and convenience only. We do not control such third party websites and we are not responsible for the content of such sites.
11. Copyright
All information and material on the website is our property or is the property of the theme park operators. In no event shall this website or the contents thereof be used for commercial purposes except as expressly permitted by these terms and conditions (personal use apart) no information, including trade marks shall be, either in whole or in part, reproduced, copied, republished, upload, downloaded, or distributed unless with our permission.
12. Validity
12.1 If any provision of the terms and conditions shall be held to be illegal, invalid or unenforceable in whole or in part, under any enactment or rule of law such a provision will be deemed not to form part of these terms and conditions and the legality, validity and enforceability of the remainder of these terms and conditions shall not be affected.
12.2 This website may only be used for lawful purposes and in accordance with these terms and conditions.
13. No Variation or Representation
Nothing said by our sales personnel regarding the products on this website shall amount to a variation of these terms and conditions or a representation about the nature or quality of our products.
14. Third Party Rights
We may transfer our rights under the contract, but otherwise nothing in these terms and conditions shall give any person who is not a party to the contract any benefit or any right to enforce any of the terms of the contract.
15. Governing Law and Jurisdiction
Your order and the formation of the contract shall be governed by and interpreted in accordance with English law. The English Courts shall have jurisdiction to hear disputes between us.
